in order to file their OPT application with USCIS. Student must be present and inside the U.S. (Students are encouraged to ensure their I-20 program end date aligns with their graduation date) Students can apply for the OPT benefit up to 90 days prior to their program end date and no later than 60 days after their program end date. Per 8 CFR 214.2(f)(11), failure to include the I-20 form with the OPT recommendation when filing the OPT application with USCIS will most likely result in the student being denied the OPT benefit by USCIS. Students must first request the recommendation from OIE before filing their application to USCIS. Students are ineligible for OPT at the lower education level after participating in practical training at a higher education level. Students become eligible for another 12 months of practical training upon changing to a higher education level.
Students are eligible for up to 12 months of OPT once per education level. If a student begins in the spring semester, they must attend a full-time spring semester and the next fall semester before becoming eligible for OPT. Students are eligible to apply for OPT after completing one academic year of full-time enrollment in Active F-1 status. This means that if a student begins their academic program in a fall semester, they will be eligible for off-campus work after attending full-time fall and spring semesters. OIE offers OPT workshops throughout the year to help students understand the application process, status maintenance requirements, travel expectations, and more. There are three types of OPT: pre-completion OPT, post-completion OPT, and STEM OPT extension. Students can utilize this benefit once per education level once they have completed at least one year in their academic program.
